1. Acceptance of Terms

By accessing or using ClaimsPilot ("the Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the Service.

2. Description of Service

ClaimsPilot is an AI-powered platform designed to help individuals navigate UK small claims court procedures. The Service provides tools including AI legal guidance, court form auto-fill, document management, deadline tracking, and template generation. The Service is a litigation workspace for self-represented litigants in England & Wales.

  • ClaimsPilot provides AI-generated guidance and informational tools only.
  • The Service does not constitute legal advice, legal representation, or a solicitor-client relationship.
  • ClaimsPilot is not a law firm and is not regulated by the Solicitors Regulation Authority (SRA).
  • All AI-generated content, templates, and form auto-fills are drafts that must be reviewed before use.
  • You should always consult a qualified solicitor or legal professional for complex matters or before taking legal action.
  • ClaimsPilot makes no guarantee of the accuracy, completeness, or suitability of any information provided.

4. User Responsibilities

By using ClaimsPilot, you agree to:

  • Provide accurate and truthful information when using the Service.
  • Review all generated documents, forms, and advice before relying on or submitting them.
  • Verification of Extraction: Manually verify all data extracted via AI Document Analysis or OCR (Optical Character Recognition) before use.
  • Keep your account credentials secure and not share them with others.
  • Use the Service only for lawful purposes and in compliance with applicable UK law.
  • Not use the Service to harass, intimidate, or make fraudulent claims.

5. AI-Generated Content & Workflow

The Service uses artificial intelligence to generate legal guidance, suggest form content, and create document templates. You acknowledge that:

  • AI-generated content may contain errors, omissions, or outdated information.
  • AI suggestions are based on general UK Civil Procedure Rules and may not account for all circumstances of your case.
  • You are solely responsible for verifying and validating any AI-generated content before use.
  • Privilege Warning: Uploading documents to an AI platform may affect “Legal Professional Privilege.” You represent that you have the right to upload any documents provided to the workspace.
  • ClaimsPilot is not liable for any consequences arising from reliance on AI-generated content.

6. Deadline Tracking & Case Management

6.1 Administrative Aid: The Case Dashboard and Deadline Tracker are provided as secondary administrative aids to help organize your claim.

6.2 User Responsibility: You maintain the ultimate legal responsibility for monitoring your case via the HMCTS portal (MCOL/OCMC) and meeting all court-mandated deadlines.

6.3 No Liability: ClaimsPilot does not guarantee the delivery of notifications and is not liable for any claims being struck out or lost due to missed deadlines or incorrect date calculations within the system.

7. Data Protection & Privacy

We take your privacy seriously. Your case data, documents, and personal information are:

  • Stored securely with encryption at rest and in transit.
  • Accessible only to you through your authenticated account.
  • Not shared with third parties except as required by law.
  • Processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

You may request deletion of your account and all associated data at any time.

8. Intellectual Property

All content, branding, and software comprising ClaimsPilot are the intellectual property of ClaimsPilot. Documents you create using the Service belong to you. You grant ClaimsPilot a limited licence to process your data solely for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law, ClaimsPilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or legal outcomes, arising from your use of the Service. The Service is provided "as is" without warranties of any kind, express or implied.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may discontinue use at any time by deleting your account.

11. Premium Credits & Purchases

  • ClaimsPilot offers one-time premium upgrades for individual case types (Claim, Defence, Enforcement) and a Complete Bundle.
  • Purchasing the Complete Bundle grants you three premium credits — one for each case type — which can be applied to any of your cases at any time.
  • Premium credits do not expire and are non-transferable.
  • Each credit can be redeemed once on a single case of the matching type.
  • All purchases are one-time payments. There are no recurring subscriptions.
  • Refund requests are handled on a case-by-case basis in accordance with UK consumer law.
  • If a case is deleted, any credit used on that case is not restored.

12. AI Assistant Fair Usage

The AI Assistant is subject to fair usage limits to ensure service quality for all users:

  • Free users: Up to 5 AI assistant requests per day across all cases. Defence and enforcement cases are limited to 5 total assistant messages per case until upgraded.
  • Premium users: Up to 100 AI assistant requests per day.

Daily limits reset every 24 hours. ClaimsPilot reserves the right to adjust these limits at any time to maintain service performance and prevent abuse. Excessive automated or scripted usage may result in temporary or permanent suspension of AI features.

13. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will endeavour to notify users of significant changes.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
